Welcome to AfriKaytering. These Terms of Service ("Terms") govern your use of our website and catering services. By engaging our services or using our website, you agree to be bound by these Terms. Please read them carefully.

1. Services

AfriKaytering provides professional catering services for events including weddings, corporate functions, private parties, and other celebrations. All services are subject to availability and must be confirmed through a signed agreement and deposit payment.

2. Booking and Confirmation

• All bookings require a signed service agreement and deposit payment to secure your event date
• We recommend booking at least 4-6 weeks in advance to ensure availability
• Express bookings (within 5 days) are subject to a 40% rush fee
• Final guest count must be confirmed 7 days before your event
• Menu selections must be finalized 14 days before your event

5. Changes and Rescheduling

• Event date changes are subject to availability
• Changes made less than 15 business days before the original date incur a convenience fee
• Guest count increases after final confirmation may incur additional charges
• Guest count decreases after final confirmation do not result in refunds

6. Service Delivery

What We Provide:

• Professional catering staff
• Food preparation and service
• Serving utensils and equipment
• Tablecloths for buffet setup
• Setup and cleanup of catering area

Client Responsibilities:

• Provide tables for food setup
• Provide plates, cups, and guest cutlery (forks, spoons, knives)
• Ensure adequate space for food preparation and service
• Provide accurate guest count and dietary restrictions
• Ensure venue permits outside catering (if applicable)

7. Dietary Restrictions and Allergies

We accommodate various dietary restrictions including vegetarian, vegan, gluten-free, and allergen-free options. All dietary requirements must be communicated at least 14 days before your event. While we take all precautions, we cannot guarantee complete allergen-free preparation due to shared kitchen facilities.

8. Damage and Liability

• A refundable damage fee may be required for certain events
• This fee covers any lost or broken equipment during your event
• The damage fee is returned within 7-10 business days if no damage occurs
• Clients are responsible for any damage to our equipment caused by their guests
• AfriKaytering maintains liability insurance for our operations

9. Travel and Service Area

• We are based in Pataskala, Ohio and serve the Columbus area
• Events within a 21-mile radius are included in standard pricing
• Events beyond 21 miles incur mileage fees based on distance
• Out-of-state events require additional fees (starting at $1,000) for travel and accommodation

10. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

11. Intellectual Property

All content on our website, including text, images, logos, and recipes, is the property of AfriKaytering and protected by copyright laws. You may not use, reproduce, or distribute our content without written permission.

12. Photography and Marketing

We may photograph our food and setup at your event for marketing purposes. If you prefer that we do not use photos from your event, please notify us in writing before your event date.

13. Limitation of Liability

To the maximum extent permitted by law, AfriKaytering's total liability for any claim arising from our services shall not exceed the total amount paid for the specific event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

14. Indemnification

You agree to indemnify and hold AfriKaytering harmless from any claims, damages, or expenses arising from your breach of these Terms, your event, or the actions of your guests.

15. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Franklin County, Ohio, in accordance with the rules of the American Arbitration Association.

16. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with your signed service agreement, constitute the entire agreement between you and AfriKaytering regarding our services.

19. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website and are effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified Terms.
